NC and SC Workers' Compensation Law Update [WebEx Meeting]

The Carolinas RIMS Chapter will host a virtual RIMS Chapter meeting on January 27, from 10:30am to 12:00pm. We are pleased to welcome two highly respected workers compensation defense attorney’s from the Law Firm Willson Jones Carter & Baxley: Jason A. Griggs and Angela (Angie) D. Zachary will present a North Carolina and South Carolina Workers’ Compensation Case Law Update. Jason practices in the firm’s Greenville, South Carolina office and Angie practices in the firm’s Charlotte, North Carolina office.

2021 Carolinas RIMS Golf Outing

At long last, after a very difficult year, we have finally been able to reschedule the Carolinas RIMS Golf Tournament! We invite you to join us at this fun event open to all golfers, regardless of skill level. The purpose of this golf outing is to raise funds for educational opportunities of Risk Management students. For this reason, all group pairings at the silver sponsorship level and above will be filled first and any remaining spots on a wait-list basis. Individual registrations will be accepted for single players. Format is Captain's Choice - 18 holes and Golf Cart is included. A single score is kept for the foursome and no handicaps are needed.

Start off 2020 with having lunch with us as we welcome Stephanie Smith, Mecklenburg County’s Director of IT Security Services. Stephanie will present “Lessons Learned”, which will cover the County’s 2017 Cybersecurity Incident. During this presentation, Smith will cover some of the most pressing threats and vulnerabilities facing many local government agencies today as well as many lessons learned from a hands on experience battling a cybersecurity incident.  Included in this presentation are the steps taken by Mecklenburg County to recover after the attack and what measures were put into place to prevent further cybersecurity incidents. 

This luncheon is $30 and will be held at Byron’s South End (101 W Worthington Ave., Charlotte, NC 28203 on Thursday, January 16, 2020. Registration will be at 11:30am and lunch will begin at 12:00pm. Parking is available in the parking deck. Follow the signs from the front of Byron’s to the alley that leads to the parking deck. Parking will be validated. See you there!

Managing Hot Potato Claims

When a loss occurs, the last thing Risk Managers and their claims teams need is anything that delays their recovery.  Unfortunately, all too often, overlapping first-party coverages cause different insurance company adjusters to point fingers at each other over which one bears responsibility for the claim.  These scenarios can play out in a variety of losses, including those involving such policies as: Property vs. Terrorism, Crime vs. Cyber, Property vs. Cyber, Builders’ Risk vs. Property, Product Recall vs. General Liability.

In this session, Jill Dalton, leader of Aon’s Property Risk Consulting Group, will discuss several different loss scenarios where insurer vs. insurer coverage disputes caused significant delays in recovery. She pinpoints the reasons why each problem arose, including vague wording in both policies that led to the dispute.  We will also discuss measures to take in advance to avoid these outcomes, as well as the role that Risk managers, their brokers and claims professionals can play in getting these matters resolved favorable  for the insured.

 Jill Dalton joins us from Aon’s NY office and is a member of the US Global Risk Consulting Risk Leadership Committee.  She has expertise in business interruption valuations, property insurance coverage analysis, supply chain quantification and terrorism insurance and the Terrorism Risk Insurance Act.

Medicare Set-Aside Update: Carolinas RIMS Luncheon on November 13

John Cattie Jr.  will be presenting “The Workers’ Compensation (WC) Industry may have a Medicare Set-Aside (MSA) Blind Spot.”  A deeper analysis of Medicare’s MSA review thresholds reveals an alarming fact: Medicare’s interests must be considered in all WC cases and ensure that Medicare pays secondary to WC in such cases. While Medicare is willing to review MSA proposals in certain settlements, that process provides no protection for RIMS members resolving claims under threshold. Join John V. Cattie, Jr., attorney and founding member of Cattie, P.L.L.C., as he discusses the MSA Blind Spot and MSA Alternatives in 2018. Mr. Cattie will also comment on a potential liability MSA review process which may reveal itself in 2019.

Storm Claims: Streamlining Your Property Insurance Claim Submission and Settlement, Presented by J Phillip Dempsey II, National General Adjuster for McLarens

Following his honorable discharge from the US Army in 1999, he obtained an Associates in General Studies from Barton County Community College in Kansas and then a Bachelor of Science in Business Management from West Virginia University Institute of Technology. 

 He then began his adjusting career in 2006 as a Property Trainee with RJMW Claims Services, handling Personal Line Claims. In 2007, he transitioned to Engle Martin & Associates, where he spent the next 9 ½ years handling large-loss commercial claims. In early 2017, he began working at McLarens Global Claims Service and continues there today. He has adjusted large-loss commercial, liability, personal lines, builder’s risk, and various other types of claims across several industries in North and South Carolina as well as several Catastrophe locations over the last 13 years.
